Legal Question in Employment Law in Georgia
Can drawing unemployment be denied for the time period of covered severance pay received based on having to sign a waiver or release of claims?
1 Answer from Attorneys
You cannot waive your right to receive unemployment benefits in GA. However, if you receive severance pay upon termination, your former employer is supposed to report that to the Georgia Department of Labor and the severance will be considered an offset, disqualifying you from receiving unemployment benefits for the number of weeks the severance is intended to cover.
