lease on property foreclosed on same day

I paid $2,000 security deposit in Dec. to move into a house in April. On April 1, the house had no hot water and was a mess. I asked them to clean and they wanted the first month's rent before they would fix the hot water. I gave them an additional $1,700. I did not move in. The next day there was a notice that the house was foreclosed on 4/1/08, the very first day of my lease. Have gotten a home-made promissory note but I fear the ''landlord'' will never pay. What can I do. Sheriff says it is civil matter but it will cost more to sue? ''Landlord'' is threatening me with harrassment because I asked for money back when I thought he was skipping out. He owns a store and was loading up mdse on a Sunday.

Having an attorney send a demand letter is a relatively low-cost way of possibly get some or all of your money back. If you are not willing to pay an attorney, you can file a claim yourself in small claims (magistrate) court.
