Legal Question in Landlord & Tenant Law in Georgia

Early Rental Lease Termination

I lost my job and had to move because I could no longer afford the house I was in. The job I subsequently got was in another state. My landlord is charging me for the remaining 8 months of the lease. Is this possible?

Re: Early Rental Lease Termination

Yes. Landlords may recover the rent you would have paid if you stayed through the lease term. However, the landlord would have an obligation to try and release the house to mitigate their damages.

If the property is in Michigan, the same law applies. They would have to take you to court to obtain a judgment, but do have a duty to mitigate damages. Contact me if you need further information. Tim Klisz
