Dispossession

My ex boyfriend asked me to leave the apartment we co signed the lease on mid month, and my name has been taken off the lease. He wants 1/2 the rent for the month he asked me to leave. I have intentions of giving it to him, but not immediately. Can he take me to small claims court?

Certainly. Anyone can file a law suit with or without cause. However, even in this situation, it sounds like he would have cause to file a claim for the rent. So, you should pay it within a reasonable amount of time.
