Legal Question in Personal Injury in Georgia

My daughter (10 yrs old) was at a softball practice and during the practice another child (age 6) ran in front of her while she was swinging the bat in a practice area. The bat made direct contact with the childs face causing extensive damage. We were at a county park during a practice with lots of people around. The younger child was warned several time about not going in the practice area by both her mom and other coaches. Who is liable for the medical damages to the child?

It's a question that no one needs to answer if everyone planned properly.

Presumably you carry homeowners or renters insurance with liability coverage for such incidents (every parent should), so you report it to them and let them sort it out.

Also. presumably you do not let your child participate in softball unless the operator of the softball carries insurance, so you also report it to them.

And presumably, you and the other parent have health insurance, so they also report it to their health insurer.

The insurers figure it all out later. And if she sues, your insurer and the softball's insurer defend you.

Otherwise, depending on detailed facts you did not give us, people get lawyers and the courts sort it out.
