Personal Injury Judgement Appealed by Insurance Company

The judgement in the Magistrate Court of GA was $3,000 each for three plaintiffs who sued for personal injury resulting from a rear-end accident. (They represented themselves and the insurance company had a lawyer for the defendant.) The defendant's insurance company offered each plaintiff $1,500 each after the judgement. The plaintiffs refused. The insurance company has now filed an appeal. Can the plaintiffs increase their claims since this matter will be taken to a higher court? If the plaintiffs hire a lawyer will they have to pay the lawyer if their $3,000 (each) judgement stands? How should the plaintiffs proceed?

Can the plaintiffs increase their claims since this matter will be taken to a higher court? Yes.

If the plaintiffs hire a lawyer will they have to pay the lawyer if their $3,000 (each) judgement stands? Well, I don't know of any lawyers who represent plaintiffs for free; however, the answer will depend on the fee agreement with the lawyer. I would advise that the plaintiffs call around an talk to a few PI attorneys.
