apt issues

I moved into my apt Sep 4th 2008. Noticing that there was mold I contacted management and they sent someone right out to clean and take care of it. In Dec I noticed it again, and again they did the same. Now its march and the mold keep returning every time it rains. So I asked to be moved into a different apt. well today they show me the new apt and it is smaller and is dirty. I asked if there was another one and they told me no ''it is what it is'' take it or leave it. So I told them I would rather move out, but their making me pay one months rent $863 and I can�t have my deposit back $795 what should I do? Take the apt that I am unsatisfied with or move out and lose money.

Consult with a local attorney. It may be that the landlord must let you out of the lease, because a landlord must provide a habitable place.
