Fence over the property line

My ''back door'' neighbor just had his property surveyed and it appears that the wooden fence he built 2-3 years ago is about 4 ft over the property line onto my property.

It also appears that he no longer is living in the house. What are my steps to ''reclaim'' my property?

What do you mean by "reclaim?" You don't lose your ownership of your property because the neighbor built a fence over the line. If you want the neighbor to remove or move the fence, talk to him about it.

I will add that neighbor disputes are usually not pretty, and often affect the quality of one's daily life. It is far, far better to resolve this dispute amicably. A simple phone call starts the process. The first letter from a lawyer changes the tone immediately, and often leads in one direction -- a lot of legal fees, and two people who proceed on "principle." Your property is important, obviously, but apparently the fence has not been a problem until now so handle this as neighbors if at all possible.
