Transfer of property

can property owned jointly be transfered without consent of both partirs

Joint property, if it is held as "Tenants In Common" may be partitioned by the Court as the result of a lawsuit to partition the property. Depending upon the state, typically "Tenancies by the Entireties," Joint tenancey" and JT w/ Right of Survivorship" cannot be partitioned.
