Normal Attorney Fee

A spouse dies and had assests that were in their name only and assests that were in both parties names (land @ home). Is the Attorney fee based upon a percentage of the value of assests or a straight cost. Thank You

The fee arrangement wss presumably agreed upon when the attorney was hired. If there was no written agreement, get together with the attorney ASAP and nail down the arrangement.

Different lawyers charge differently in probates, depending on the difficulty of the case, value of the estate, the amount of legwork the executor will do, whether heirs get along, the lawyer's experience, and other factors. Oftimes there is a flat fee. Some fees may be aseet based or hourly. Many probates can be handled for a few hundred dollars. Some cost far more. There's no one formula used by all lawyers.
