Legal Question in Wills and Trusts in Georgia

Trust/Will/Guardianship problems

I am 20 years old, my mother died when I was 14, my uncle became my legal guardian and since then has tried to distribute the trust correctly. Recently, I felt the need to move out of his home due to personal/emotional problems with him and his family. I am in school with 2 jobs and a grade point average of 3.15. I have good friends and I stay out of trouble. He says that in the will if I move out then he has to end the trust ( he gets all the money). Right now the situation has gotten nasty because he is trying to force me to come home because he says that he is my legal guardian until I am 25 years of age. I do not have a copy of the will, he said he would make me a copy but, I have not yet received it. He will not let any other family member see the will. My aunt, tried to get a copy of the will from the courthouse, but it turns out that the will was never filed. It has been 5 years. So, I guess my question is 1) if the will has not been properly filed, is it still in effect? 2) How would I prove that the environment is not suitable for me?

Re: Trust/Will/Guardianship problems

You need to consult with a local attorney with an eye toward forcing your uncle to let the attorney review the will and trust documents. Also, it sounds a little fishy that "the will had not been filed".
