Legal Question in Workers Comp in Georgia

How long after a permanent injury do you have to make a claim?

I was injured on the job,i got my hand caught in my machine and messed it up bad. It has been over a year and i am still having lots of problems. The bad thing about it is that it is my left hand, my ''everything'' hand. They are trying to say that i have to give them a recorded statement, and an ''over the phone'' meeting to be considered for more treatment. I have not been released from the doctor and i no longer work for the company( if you wanna call it a company) Please I need help.I cant afford an attorney and i just want to medical attention for as long as i have problems.I am not trying to make money off this. Can they deny me this?

Re: How long after a permanent injury do you have to make a claim?

If you are injured on the job in the state of Alabama, you are entitled to workers compensation benefits. Said benefits include Temporary Total Disability while you are unable to work (2/3 of your average weekly wage), medical treatment for said injury for the rest of your life, and possibly compensation for a Permanent Partial Disability or Permanent Total disability. Said compensation is calculated according to the formulas provided in the Code of Alabama. If the machine which injured you did not have the appropriate guard, you could also have a third party claim. I would NOT give a recorded statement without an attorney. Most attorneys do not charge you unless a recovery is made, and therefore, it shouldn't cost you anything to employ an attorney. If you have any further questions, please do not hesitate to give me a call. Sincerely, Jon E. Lewis (205) 254-3927.

If your injury occurred in Georgia, your rights are very similar to those described by the Alabama attorney. Generally, a workers comp claim must be filed within one year of the injury or one year from the time the employer last provided medical care for the injury. There are exceptions to this rule, however.
