Wedding Fraud

My wife and I were married November 8th, 2008, and we paid a videographer to handle the wedding. After saying he'd have it for mid february, he ended up making excuses like it's still in editing or the editor just had a baby, and he kept delaying the date weeks at a time. It is now mid April, and he hasn't returned my calls for the last 3 weeks. I put together a fake email and sent him an interest as someone getting married this summer. he replied to the email and I set up an appointment tonight. He thinks it's someone else, not me, but it was the only way i could speak to him. Should I give him an ultimatum tonight like ''video by ???? or i take him to small claims'' or should I get a lawyer, or should I not of set up this fake appointment in the first place?

I answered your inquiry before. There is no doubt in my mind that the video is lost or destroyed. Ask him for your money back. If he fails to do so, you can sue him in small claims, hire or not hire an attorney, report him to the BBB, set up a blog that states factually, truthfully and accuarately what your expereince has been
