Legal Question in Credit and Debt Law in Illinois

Unfair Practice

I have a debt that I owe. I contacted the law office that tried o contact me about a debt. This conversation took place in August 2007. After speaking with a representative we agreed on a settlment agreement to be paid in the amount of 250.00 on the 21st of every month until debt was paid. Starting in September. I paid the agreed amount early in August. I have not once been late on a payment and sent the payments certified mail. Now all of a sudden I see a letter on my home a summons for me to appear in court. I called the law office to gain explaination and they said there client wanted to seek action and then went ahead and did it, but this is not in the settlement aggreement. This information was not clear and now the law office is saying that I have to pay additional interest 24% and lawyer fees and court fees. I feel that I was close to paying my debt off and now with all of these so called fees I owe more than I had to pay in the beginning. What can I do? My original balance was 2898.51. I have paid 1000.00 toward this debt and should only owe 1898.51. I want to just pay this amount and be done with this but now with the possibility of all these new fees that I did not know exist this really puts a hurt on. help

Re: Unfair Practice

If the settlement agreement was not in writing, you will have a huge problem proving that it existed. If it is in writing, you can use it as a defense
