Legal Question in DUI Law in Illinois

Aggravated DUI Charge - 3 1/2 years old. Illinois Department of Transportation erected a memorial sign before the jury pool was selected. Local newspapers side with other victim and even use the word killed the motorcycle driver and have many other false statements. State's attorney releases toxicology evidence to Illinois Department of Transportation.

My question is do we have a good position to get this case dismissed? Can we sue the newspapers and Illinois Department of Transportaton for defamation of character? Can the State's Attorney releasse toxicology reports to the newspapers and Illinois Department of Transportation?

Cases don't get dismissed that way. There may be issues affecting a fair jury pool. You should have an experienced DUI attorney. I would not be concerned with lawsuits right now. You need to focus on your defense to the agg DUI charge.
