Legal Question in DUI Law in Illinois

Court Supervision

My 17 year old son was put on court supervision until January 14, 2009 for a DUI. On June 26, 2008 he was picked up for minor drinking.

He was not driving but walking.

The courts are going to revoke his supervision and resentence him.

Can you please tell me what will happen?

This is an extremely difficult question to answer as you did not say what county the case is pending in, and then what judge; each judge can be different. Not trying to be difficult here, but a lot has to do with facts not at hand..... Good Luck.

In general, what could happen is that your son will get a conviction for the DUI. This will suspend his driving privliges for at least one year, and be on his record for the rest of his life. A second DUI conviction will get his license indefinitly revoked. A third offense of a DUI will be charged as a felony. One of the conditions of supervision is that your son not commit any offenses while on supervision, which he apparently violated.
