Legal Question in DUI Law in Illinois

Illegal consumption illinois

My son was 2mo from his 21st birthday when he was ticketed for Illegal Consumption. This is his second offence, the first being when he was 17. At court today, without a lawyer, he had to pay 198 dollars, was given 2 weekends to serve in county jail and 2years probation, being he can not buy, possess alcohol or be in a place that selling alcohol is its only service and go to counceling. Another person arrested the same night got a fine and community service, she is an 18yr old girl. Is this fair, is this typical? Is this something he needs to have removed from his record, they gave him info on how to have it expunged? Also why is this illegal consumption classified under DUI, there was not a car involved, they were in a home. Also, it is not the county we live in, and other kids from our county that were arrested in our county for the same thing, were only given fines, and nothing else? Thank You

Re: Illegal consumption illinois

Why would you let your son go to court without an attorney representing him, and then seek free legal advice on this site after the fact? It seems to me that it would have been wiser to hire an attorney to represent him in the first place. Also, why are you concerned about the disposition of someone else's case? There is no law that everyone charged with the same offense gets the same deal.
