Legal Question in DUI Law in Illinois

Underaged Drinking at a Party -- What Happens?

Recently, I was at a party with underage drinkers that got broken up by the police. I am 18. The police got my name, number, birth date, and address & then they let me go. I was not given a breathalyzer or a ticket nor was I arrested. In fact, some of the police officers just let some of the kids go without asking for their information. The host of the party was around 23, I believe. This is my first offense. I was just wondering what is going to happen next? I was told by some friends that I would get a fine and possibly have my driving privileges revoked? Will this be on my permanent record?

If charges get filed, you should be worried about losing your license and paying a fine. Depending on where the charges are filed, you may be eligible for diversion program that will keep the charge off your record and prevent you from losing your license. If there is no diversion program available for you, then court supervision is the next best thing. With supervision, you will lose your license, but no conviction enters on your record and the case may be expunged down the road.

You may want to consider hiring a lawyer from your area to find out if charges are going to be filed against you, and if so, to defend you against the charges.

I really found it unclear from your question as to whether you were actually charged with any offense. Did you receive a ticket? If you do get charged, you should consider hiring a lawyer. This might be too complicated for you. Good Luck!!!
