Legal Question in Family Law in Illinois

My daughter has turned 18 and no longer lives with her mother. Her mother is seeking child support to be extended until she is 19. My daughter is still going to school and has a 25 hour a week job. She goes to school half a day and works in the afternoon. I was divorced in 1997.

Arguably your daughter is now emancipated and your support should terminate on her 18th birthday. However, that may not be true even though she no longer lives at home as she may still be dependent on Mom to meet or help meet her expenses. State law says that support continues until she graduates from high school or is 19 whichever comes first.
