Legal Question in Family Law in Illinois

ex-wife to- be being unreasonable

My boyfriend has been going through a divorce since Dec'01. HER CHOICE. He left his home and has paid (of their savings)over 36k for her to keep the house until they settle. Her attorney told the judge her father was going to ''take care of it'' after they get divorced. He has money... My boyfriend pays 1,500 for his own place. Now that the savings is gone, he can't possibly pay her $2240 a month, pay his rent and pay her mortgage (2k). She petitioned to force him. They meet Tuesday. Can the Judge force him to pay this? he won't have a nickel for anything!! He offered her 50k (he makes 110,000) and 30% of any bonus money (although there hasn't been any)annually. He wants 1/2 of the equity in the home since he is paying her support until the kids are 18. She wants him to have 40% and to pay HER health insurance too!! She has many medical problems and this could cost him dearly on top of the alimony!! Will the judge really give her ALL of this or should he take his chances at trial? I am afraid he is going to be treated unfairly as the judge is a woman. I met him after she kicked him out and he is a model father and a wonderful man. I know the judge doesn't care that his ex is crazy... Any advice would be helpful!

Re: ex-wife to- be being unreasonable

I think the judge does care what's going on and should be informed of all of this information. A judge will not force him to go broke to support her. The house could go into a sale if nobody can afford it and she could have to move into a cheaper home. My major problem is that he does not have an attorney. He needs to hire one. He must protect his interests. I would not advise his taking a chance at trial without an attorney.
