Legal Question in Family Law in Illinois

Removing my boyfriend from my home

I currently have a live-in boyfriend that has no job and doesn't pay any of the bills. The only things he has in my home is some of his personal belongings. I want to throw him out but he keeps telling me I can't because I have to give him notice. Is this correct, do I have to give notice for someone to get out of my house?

Yes, you have to formally evict him.

Your boyfriend is in your home as your guest. You do not have to evict him, you merely have to tell him to leave. If he refuses call the police and charge him with trespass. This, of course, assumes that he's not on the title or mortgage and doesn't have a lease or rental agreement with you. To protect yourself and to show both your BF and the police that you are serious, I would suggest that you give him something similar to a 5 day notice, however, this is not a legal requirement. You may want to review the local ordinances in the area where you live.
