Split Custody/Child Support

My ex husband and I each have 1 child residing with us. He makes 4000 a month and I make about 800.00. Our son is disabled and resides me and his ssi is 1/2 of my income monthly. Can I take my husband for child support even though he has one of our children living with him? He is miiltary and resides in Texas. I live in Illinois.

Absolutely. The "one kid each" doesn't work if one kid costs a lot more to care for than the other. And since he makes five times what you do, its only reasonable that he contribute more. This will require a hearing. Another point to consider is that it will be a lot harder for him to fight a motion you bring in IL since he is in TX. Let me know if you have any further questions.
