Legal Question in Civil Litigation in Illinois

My business partner lives in my apartment with me. She does not own a home because she is a foreigner and not a US citizen. I have asked her to leave but she stated she will only leave if I give her half of my property. She has no rightful, legal claim to my property. I never told her I would give her any share. How can I make her leave?

Hello. This is somewhat awkward due to your business arrangement. However, the best way to proceed is to serve your business partner with a 30 day notice of termination of tenancy. Fill the affidavit out completely as to when and where you served her. In fact, you may want to have a third party serve her. If she does not move within the 30 days, then you have a right to file a forcible eviction action against her in court. I anticipate that once you serve her with the 30 day notice, your relationship with her will deteriorate significantly which may have an adverse affect upon your business. I agree with Zedrick. She is basically a subtenant on a month to month oral lease and is entitled to 30 days notice.
