Fixed marriage

My friend was a victim of domestic violence for yrs. While being married to her husband, he made her marry another man for the residency. He fixed everyting and even paid for her divorce. Now he put her out of their home with their 3 children. She wants to get a divorce but he's threatening her eventhough he did the same thing (commited bigamy just to obtain his residency). What is the risk of her being deported. Her 3 children are US born citizens. She has proof of the physical and emotional abuse she receieved: police reports, orders of protections as well as records from her psycholist. Can she be incarcerated?

It seems clear that your friend is a victim of criminal activity and should do her best to get away from this individual. Now, you must be clear about the statuses of these individuals. The abusive husband is a lawful permanent resident, right? She has no status, or is a lawful permanent resident, which one? Who is this person she was forced to marry, and what is his status? She should find an immigration lawyer right away and file for a "U" visa. It appears as if she has good evidence, and will be willing to bring charges against him if necessary. Bigamy is a crime in most states. Forcing a wife to marry someone else while still married is a crime; and continuing to abuse her psychologically with threats is a crime. She will not be incarcerated if she files for that visa immediately, okay? Be a good friend and find her a good immigration attorney! Good luck and I hope all goes well!
