Legal Question in Immigration Law in Illinois

Will my gf be able to stay in the US if she is here on a J-1???

My gf is here as aupair for the last 15 months on a J-1. She has left the program and would like to continue to stay and work here in the US. We want to get married asap but we are unsure of the 2 year rule. Her visa is stamped with a experation month of Aug 07. Will she have to go back to her Country for 2 years before returning? Will marrying her help? Any advice or comments would be greatly appriciated.

You will need to find out (for sure) whether or not the two year foreign residency requirement applies to her J-1 status. There is a special procedure that needs to be undertaken with the U.S. Department of State to find this out. You can feel free to contact our office and we would be pleased to provide you with those services.
