can they hold my paycheck for 8 months?

I quit a job, the owner of the place said that he can legally hold my check for 8 months and intends to. I said I would turn him in to labor board and he said go ahead. can he keep my check for 8 months?

No, the employer cannot hold your check for 8 months. Maybe s/he is telling you that because it is his/her experience that it takes a wage claim 8 months to get processed with the Illinois Department of Labor. You can go to the IDOL website and file your own claim without a lawyer. Also, if the employer has the means to pay you on time and fails to pay, the person who made the decision to withhold the check may also be liable. Good luck.
