Legal Question in Medical Malpractice in Illinois

Telephone Conference

I am a resident physician, now asked to participate in a telephone conference with my hospital's lawyers about a malpractice case a patient is bringing forth. I don't remember the patient at all. The chart will be mailed to me shortly.

My question is: how does a telephone conference work? Any advice? Will I be taped?

It does not matter that you do not remember the patient. All you have to do is to review the chart and refer to it, if need be, and answer questions you are asked to the best of your ability. Be truthful. Do not guess. If you know the answer say it, if you do not know say it as well. In all likelihood the phone conversation will be recorded and transcribed. You have the right to have an attorney on your side protecting and advising you. If you are unsure about anything or the process, hire a lawyer (in some cases the Hospital's insurance company will have to pick up the costs--ask them about it).
