Legal Question in Personal Injury in Illinois

I have an lawyer that took over my case in 2006 for an car accident. I keep asking him for money but he tells me that he's having finances problem and he dont have an money to give me what should i do?

His fianances should have no bearing on your case. Also, you typically only have 2 years from the date of the collision to file a claim.

I am often asked by my clients to lend them money while their case is pending. Lending money to a client is unethical and the lawyer can lose his license for doing so. So, it is possible that he is telling you that he cannot give you money and he is giving you a reason for it.

Having said that--You need to find out what is the situation with your case. A lawsuit should have been on file by 2008-it is possible that it is taking this long to get the matter to a jury trial although rare, it does happen that a case may take many years to bring to a verdict.

I suggest you send your attorney a certified mail with return receipt requested and ask for a status on your case. Ask to see a copy of the complaint that was filed. Once you have the court case number, you can then check the progress of the file using the clerk's website.

If the attorney is giving you the runaround, and is not giving you a copy of the complaint showing the file stamp and the date of the filing, and is not giving you proper answers, then you may need to consult with another attorney because you have an absolute right to know what is the status of your case.
