Will we have to pay?

On June 14 2006 my brother was involved in an accident. He was riding his bike and waiting on the corner for the light. When it turned green he started across the street and was plowed into by a 76 year old man. It was in a residential area and he should have been going 20 miles an hour but was still going 40. He hit him in a crosswalk and left him w/ a shattered leg and lacerations to the head. The man said my brother came out of nowhere along with other witnesses. However I have been with him many times and he looks several times before crossing. Now the man's insurance company might not pay for my brother's medical bills. Is that fair? The man didn't even receive a ticket for hitting my brother. We believe he is an ex-marine and has friends in that town's police department. My brother will not be able to work for at least 3 months. Is there anyway that we will be able to nail this guy and make him pay for the damages he caused us? We have taken pics of the accident scene and where the skid marks take place. There is no way he shouldn't have seen my brother. And the skid marks start way after he was hit. There was no walk, dont walk sign so my brother was not wrong for crossing. This man is in the wrong. Please help! Thank you!

I help victims like your brother every day and have been doing so for almost 25 years. I am very intrigued by the skid marks and the speed that the other driver was traveling. It sounds to me like your brother may have a case.

However, I will need to talk with you and your brother, obtain a police report, look at your pictures and visit the scene. Additionally, do you know whether there was newspaper coverage locally?
