Legal Question in Traffic Law in Illinois

Driving on suspended license

I was pulled over for not wearing a seat belt in Sterling, IL. My driver's license was suspended for a dui. The suspension was over at the time of the incident but my reinstatement fee had not went through yet. I got my license back about 10 days later. When I went to court last week in Sterling the state's attorney told me their was a mandatory 10 day jail sentence and their was nothing he could do about it. He advised me to hire an attorney. Isn't their another solution where I won't have to do jail time? Thanks.

Re: Driving on suspended license

There is a mandatory sentence in this case of a minimum 10 days in jail (or 30 days community service if that is an option). That is if there is a "conviction". I have a similar case now, and expect to arrange court supervision for my client. In the event of a supervision, there is not a mandatory jail sentence. Should you hire an attorney you should talk to him about this possibility. Should you wish to speak with me about your situation, please respond by return e-mail.
