Legal Question in Wills and Trusts in Illinois

finding how an estate was probated

My father-in-law died in 1962, in IL. His sons were always told that there was not a signed will. How can we find out how the estate was probated and if there was a will. We live in AZ, and traveling to IL is not possible at this time. Can we look up the information on line?

Re: finding how an estate was probated

I don't know if the probate court where the father-in-law's estate was probated has scanned the probate file and if it is accessible online. You would have to contact the clerk of the probate court in the county where he died and ask them if there is a probate case. It is certainly possible that no probate was filed, or if there was one, that the estate was intestate (no Will) or if a Will was filed. Try doing this by phone.
