Legal Question in Wills and Trusts in Illinois

Legal Questions for a Will and Estate

My mother and my stepfather were married and my mother passed away. A few years later my stepfather passed away, but he told me that there was a will and that I would be the main beneficiary. It has been about 6 months and his brothers have recently sold the house and taken many of the belongings and I have yet to see a copy of this will. Are they allowed to sell the house without contacting a beneficiary of the estate? Also, how would I go about finding the will because his family is refusing to give me the name of the lawyer who was in charge of the will? Thank you for your help.

Re: Legal Questions for a Will and Estate

If there is a will in existence, the fiduciary (executor or the lawyer) in possession of the will is required by law to file it with the Clerk of the Court of the county in which the decedent resided.

As a first step, you can check with the Probate Clerk of the County to see if a will was filed. If it was, you have a right to look at the will in their office and to make a copy.

Good luck to you.
