Legal Question in Wills and Trusts in Illinois

Out of Line?

I have a question about my father's estate. My father passed away late 2004. I was named in his will the sole beneficiary to his estate. MY stepmother renounced the will and the renounciation was filed with probate court. My Father's total assets were over 700K. I understand the house and 3 vehicles & 401k & joint account pass outside probate because both names are on titles & deeds(J/T). Those items are worth over 400k and leaves peronsal property and 1 savings account for the bulk of the estate. I can't get a straight answer on how the bulk of the estate will be split? Stepmother is also asking for 35k in spousal support. Will a probate judge use all this info when it appears in front of him. Help me!

Re: Out of Line?

It sounds like to really need to have an attorney review your situation - with all available documents for review - in order to determine your rights.

Otherwise, any answer will only be incomplete.
