Legal Question in Wills and Trusts in Illinois

My mother died without a legal will, and before my sister was legally named Executor she cashed 4 insurance policies and distributed the funds to herself and another sister, and tells me she does not have to tell me the names of the beneficiaries on the policies. The will filed in court does not include the 4 insurance policies. It has been almost 2 years since my mother died. What rights do I have?

Insurance policies are ser to be distributed to the named beneficiaries. Most times, the owner of the policy will name a beneficiary other than their estate. If your sister or a person other than you was named as a beneficiary, then she would be within her right to not reveal the information to you. Typically, an insurance company will not distribute the proceeds of the policy unless all beneficiaries have accepted in writing.

If you know the name of the insurance company, they will provide you with information IF you were a named beneficiary.

Good luck to you.
