Respected lawyers,

I am hindu ang got married under HMA.At the time of marriage my parents exaggerate my qualification to my husband's family.After marriage when my husband actually came to know about my actual qualification he said he likes me so its no more important for him whats my qualification.After that he continued our relationship.

But after his parents visit our house problem started.He has file for divorce on the ground of mental cruelty and fraud.My question is even after knowing my actual qualification my husbnad continued his relationship with me.Now when he wants to divorce me he is raising qualification issue and saying marriage is based on fraud.Besides contresting divorce case is there any other case i can file against him for raising the issue in divorce case which he condoned and stayed with me even after knowing about it?

Yes. you can file various cases and even indulge his parents too. Now a days its world of woman. First of all he has to prove that you mentined wrong education. Secondly if he was aware then continued it means he accepted and therefore it is not a ground or fraud. For other cases, dowry demand and domestic violance are your weapons to teah them a lesson and get your husband back.

You are entitled to seek his crinminal prosecution for "cruelty" under section 498-A IPC and may also seek compensation under the Domestic Violence laws.

If you demonstrate in the court that the issue was condoned by him his case would be weak. You can also approach a local lawyer and take an opinion in respect of DVA.

Contention of fraud on the basis of allegation of concealment of qualification may not stand trial. If the divorce is on this sole ground, your husband is not likely to get a decree.
