Legal Question in Employment Law in India

domestic enquiry

In a co-operative soceity two persons were chargesheeted for mishandling some money. 1st one in managerial category and 2nd one in clerical grade. In answer to the chargesheet manager told that clerk didn't handover money to him but clerk told he had handed over the money to the manager. Being a member of Board(Disciplinary Authority) how can we present witnesses ? Can anyone of two( if found exonerated in one enquiry )can be used as witness in the second enquiry ?

Re: domestic enquiry

You have to deal both the persons separately by asking different questions by different members at different intervals. So you may get a very good calrity in the answers, this is a very normal type of interrogation by the police in case of petty thieves. These kind of questioning would have to be done if the society has not lodged any case with police and once if you involve the police then your enquiries should be excepted.
