Legal Question in Employment Law in India

validity of service agreements

I have a service agreement with my company. It is almost over .I have a clause where I was asked to furnish a bond stating that if I do leave before 2 years:

1. I will pay Rs 2lakhs

2. I will return all I have earned i.e. my salary

3. All training expenses

4. Any other damages

All this when my salary is Just 2.1 lakh p/a

I have almost finished my bond , and would lie to know if I can file a case against teh company saying it is exploiting the market or any other grounds.

Also one has to pay even if the company asks one to leave!

there are no terms in favour of the employee in teh bond. The company calls it a service agreement!

I would also like to know the validity of such bonds. It is on a Rs 100 stamp paper and has 2 guarantors.

Please help.

Re: validity of service agreements

I would like to know more details about the company as well as the agreement. If the contract is biased it can be challenged in a court. If the company terminates your services you are not liable to pay anything to the company.Instead you can ask for the salary for the unexpired period of the contract.
