Legal Question in Real Estate Law in India

(Janachaitanya)Real Estate firm not handing over the plot

We have paid the complete instalments before the due date i.e.(20/12/2004)but the real estate firm is not registering the plot in my name and whenever we approach them thay are saying that there is problem going on in the layout. I approached police station of that area and told the same thing to the circle inspector but even he is not ready to lodge an FIR against them he says it is a civil matter approach court or you kick them to get your plot. Please help me as I took loan to pay the instalments.

I have gone through your query. You can approach the consumer forum and you also can file a civil case for recovery of money and damages.

Do you have an agreement in your favour from the real estate firm?

You need to check limitation aspect from the terms of your agreement.

If within limitation, you can file a suit for specific performance.
