Legal Question in Criminal Law in Indiana

My 21 year old son attends college in Indiana. While there he got a public intoxication violation. We hired and paid an attorney to represent him and waive the pre trial diversion in March. He was told, last month, that all the nessesary forms had been filed and we were under the impression the case was complete. Today I recieved a letter from the court for a warrant for his arrest because he apparently missed his court hearing. The lawyer failed to submit the appropriate paperwork so the initial court date was never dismissed. We phoned the office and they did tell us they would do it however my question is... because we were required to pay the fee up front and he did tell us the procedure was complete but he actually hadn't done anything am I entitled to request some or all of my funds back ?
