Legal Question in Family Law in Indiana

Going Back to court

In a nut shell. My divorced was in IN and now 3 years later my X is taking me back to court to have the child support stopped on the grounds ''to have this child emansiputed''. I do not know what this means totally. She is still very dependent on me even though she is 18. Can someone help me ?? Thank you...

Re: Going Back to court

Unless your divorce decree orders that he pay child support beyond the child's 18 birthday, his legal obligation to pay support ends when the child turns 18 or graduates high school, whichever occurrs last. In other words, if your child was still in high school, he must continue to pay support until she graduates. If she has graduated high school, or quit high school, and is now 18, then his child support stops UNLESS your divorce decree states that he pays support until your child is 19, 20, etc. But most decrees in TN don't say that. So you may be out of luck.
