Legal Question in Employment Law in Indiana

Adult coworker verbally abusing a minor employee.

My son works as a disc-jockey at a roller rink in a small town. He is 16 yrs. old. His dream career is in radio broadcasting. A 24 yr.old co-worker is verbally abusive, foul language, threatens physical harm,&generally has frequent temper tantrums. I am going to speak to him about this behavior towards my son. Are there any laws being broken here that I can inform of pertaining to his behavior.

Re: Adult coworker verbally abusing a minor employee.

Intentional infliction of emotional distress is actionable for damages. Your son is an employee and may be entitled to work comp for stress leave. An action against the owner is possible if he knows what is going on and does nothing about it. That is ratification. Note that the damages must be SEVERE emotional distress which means psychological intervention in most cases.
