Legal Question in Employment Law in Indiana

Being fired over a work restriction

My mother was told that part of her job was pressing and due to 5 years of pressing she has screwed up her hands so bad that her thumbs are rubbing bone to bone...she is seeing a doctor who put her on a work restriction from pressing but they said if she can longer press they have to let her go, how is this fair, the doctor does not want her press but she does SO MUCH MORE AT WORK, she runs a lab....

Voyle A. Glover Attorney at Law

Re: Being fired over a work restriction

She needs to see an attorney experienced in the federal discrimination laws (ADA - Americans with Disabilities Act) She may have a case. The company is required, under the law, to make a "reasonable accommodation." It could be that there is no accommodation that is reasonable, but that's an evaluation that a professional needs to make--not her. And merely because the company position is that there is no reasonable accommodation that can be made, does not make it true.

Have her contact an attorney in her area or close enough for her to drive to his/her office and discuss the case.

The attorney will advise her to immediately file a complaint with the EEOC and will advise her as to where and how to do that, and may even help her draft it.
