Legal Question in Medical Malpractice in Indiana

My mother fell down a flight of stairs at my sisters house. She was complaining of a headache and taken to the hospital Logan Campus in Danville IL. twice and was sent home. The headaches got worse. She was taken to the hospital a third time. During this visit at the emergency room the doctor gave her a CAT Scan and it was discovered that her braid was bleeding. The doctors performed surgery to stop the bleeding. Six months later November 15, 2007 she passed away. My mothers death is a traumatic event in my life. I can't explain to you in words what how her death has negatively impacted my life. I would like to know if I have a malpractice suit. I need a peace of mind. My soul and spirit needs rest

I am sorry for your loss. You may or may not have a malpractice suit. You would need to have the records reviewed to determine what symptoms and what procedures were performed during the first two visits, what changed if anything the third time, and whether the delay in surgery was a cause of your mother's death. Additionally, a determination would have to be made whether based on the presentation, the hospital did not follow the standard of care.
