Legal Question in Real Estate Law in Indiana

Fuel Oil leaking into our basement

We would like to know if we can sue the Real estate agent for failure to disclose. There are fuel oil tanks buried on our property, we have several reports indicating that this was a preexisting condition, a local contractor had removed tanks prior to this sell, the fire department also has reports. Neighbors are willing to also testify to this fact. We were lied to about the sell of this home, we were told the home was brand new and that no one had ever lived in the home, we now know these are all false statements. Could you help?

You should contact an attorney. I'm afraid you may not get far without doing that. Mary

You will need to contact an attorney. It does sound as if there may be a cause of acton against the broker if the broeker knew it was not a new home. A selling agent has a duty to be honest and not make fasle statements. You may also file a suit against the fomrer home owner.
