Legal Question in DUI Law in Kansas

Charged with DUI, completed diversion, case dismissed.

I was charged with a DUI in 1996 and my drivers liscense was suspended for one month. I entered a diversion program for first time offenders and successfully completed it, where by the charges where dismissed.

When asked on an employment application if I have ever been convicted by any law enforecment authorities of any violation, should I answer yes or no? I am fairly certain this company will conduct a background investigation. Should I disclose that I was charged with a DUI and the case was dismissed?

Failure to disclose convictions will result in dismissal from this company.

You were not convicted, so it is truthful to tell them that. Most companies are smart enough to ask if you have ever been CHARGED with a crime. Then you would have to answer yes. Another step you could take would be to have the arrest and diversion expunged from your record. Then nobody has the right to find out about these except for a few government purposes.
