Legal Question in DUI Law in Kansas

waiting for bail hearing

My daughter was arrested on 8-25-06. She has not seen a judge. An officer gave her a bond paper for $7,500.00. Should she wait to see a judge or try to get a bail bond? How long will it be before she sees a judge? Will a judge lower her bond & does she need an attorney other than the court appointed one? She is charged with open container, minor in consumption, DUI, driving on suspended, refusal of breath test and left of center. She was also charged a month ago with a DUI. Please help.

Re: waiting for bail hearing

If this is her second DUI in a month, I strongly suggest that she obtain private counsel. Court appointed attorneys are fine for small charges, but are sometimes too overloaded and thus under enthused to fight for the best outcome for a defedant, facing significant jail time, like your daughter. If she requests an appointed attorney, she should meet with them and decide if she wants to trust her liberty to them. Perhaps the appointed counsel will be best for her. But, she has the possibility of being locked up for a long time, and should decide on her counsel carefully.

Good Luck
