Legal Question in Family Law in Kansas

My 16 yr old son lives with his father and he was removed as a child in need of care and put into foster care and now is in a group home. Are both parents charged with neglect am i responsible for what goes on in his house. We live in Kansas and are divorced

This case seems odd. Normally when a chidl is removed from one divorced parent they are sent to the other. In this case, there maust have been some reason why that was not done. That reason may be the thing that defends you from an action by teh state of others for damages from what "activities: the child does. If your chdil is in foster group home care< i assuem that you are trying to get him. Your attempt to get custody may be hat defends you form a charge of neglect or abuse occurring in your Ex's home. If you do nto try or are unsuccessful in getting custody, then the state may come after you for the cost fo his care in state custoday. If he is to be adopted, they will have to terminate your parental rights. That will be couched as case against you and your ex. You may agree to it or not.
