Legal Question in Workers Comp in Kansas

mileage reimbursment

Can you please tell me how long workers comp or the company lawyer in a kansas case has to pay for mileage reimbursement. I have terminated my attorney due to he has been through three paralegals and i don't feel i was properly represented. I have been waiting two months for a mileage check. So far it's 800 miles and i'm not done with physical therapy. I'm looking for kansas forms and websites to help me with my case, not been to lucky. I know getting another attorney is going to be difficult but i've got to keep the ball rolling. I can't afford to finish pt because they won't pay my mileage. Please advise if you know the time frame on reimbursement in kansas. Thank You in advance

Re: mileage reimbursment

In a Kansas Workers' Compensation action, a claimant who is not receiving benefits (normally medical treatment or weekly temporary total benefits) can request a Preliminary Hearing before the Administrative Law Judge assigned to the case. If treatment is being affected due to claimant's inability to afford travel expenses, mileage reimbursement can also be requested. Certain paperwork requirements apply. Usually, a Preliminary Hearing is not held on a request for medical mileage alone. A trip must exceed five miles to be eligible for reimbursement. Consult your attorney for advice.
