Legal Question in Consumer Law in Kentucky

purchase of farm tractor

we purchased a new tractor less than 1 year ago. It had 3 year warranty, in 6 months, the hydraulic pump went out, had to pay out of pocket to have it fixed the company wouldn't back the warranty. Got the tractor back in Jan. and in 2 weeks the head gasket is blown, and the same thing, the company will not back the warranty, so it is out of pocket again. Is there something we can do?

Re: purchase of farm tractor

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case.

You may have some legal rights against the company who issued the warranty, depending upon the exact terms of warranty.

It is virtually impossible for an attorney to advise you of your rights and obligations under the terms of a written contract such as a warranty, without having an opportunity to review that warranty.

You should not take any action, based upon my advice, without consulting an attorney and explaining all the facts to him. You are best advised to seek the services of a competent Kentucky attorney. You can telephone your local bar association for a referral, or can find a good lawyer on-line at the Kentucky Bar Association's Lawyer Referral Service:
