Re: charged with assault, never touched anyone

It is not possible to give you a clear legal answer to your inquiry without a more detailed evaluation of the facts of your case. Several questions are presented:

(1) Was your grandson assisting the other teenager in any way to commit the assault? (It is legally an assault, even if no battery occurs, when you threaten another with physical violence.)

(2) Did your grandson confess to anything?

(3) Did your grandson plead guilty?

(4) Was your grandson represented by a competent attorney?

(5) When was your grandson sentenced? (There are time limits for certain types of appeals.)

You should talk this matter over with an attorney, to determine what legal avenues are left open for your grandson.

You are best advised to seek the services of a competent Kentucky attorney. You can get a referral to a criminal law specialist from the Kentucky Association of Criminal Defense Lawyers, at

Additionally, you can telephone your local bar association for a referral, or can find a good lawyer on-line at the Kentucky Bar Association's Lawyer Referral Service:
